Hi folks, we had a tenancy agreement for our family owned commercial property that was leased to a restaurant. When Covid hit, we foregoed rents for a couple of months and then reduced the rents by 25% and still continue the same rates.

Even with these arrangements in place, they have defaulted rent for 3 months and went on to make structural changes to the building. They took down internal walls, extended their kitchen into the backyard and overall maintaining a very filthy environment.

It is now clear to us that we will not renew their contract, however I don’t want them to simply walk away leaving us to clean up their mess. How much of a legal hassle would it be to get them to pay ? Is it well within our rights ?

Unfortunately, the family members are scattered around the globe and only one of us is suffering. It’s a collective decision, but we don’t have the manpower nor the time to run behind the problem. Sorry if that sounds brash, but that’s the reality of the situation.

Any advice would be greatly appreciated. I wanted to gauge what we’re looking at in terms of money and time. Thank you !
