Recently High Courts have held that Private Medical Negligence Complaints are Not Maintainable Without Expert Opinion Of Another Doctor Supporting Allegations.
3. Check if your case falls under the guidelines for prosecuting doctors. These guidelines were laid down in the case of Jacob Mathew v. State of Punjab.

May 7, 2025 at 7:05 amSir actually my father who is no more, had a kidney removal operation due to tumour growth in Gurgaon last year in a well reputed hospital. The biopsy showed the presence of cancer cell which were not discussed with us and the doctor also did not asked us to go for cancer therapy as preventive measure which is recommended in normal cases. My father went for follow up check up where he was told to go for ultrasound. It was done in a hurry as there
Were other patients in the queue where nothing was detected. Later he started having extreme pain in stomach when we decided to go CT scan ourself and came to know about recurrence of the tumor in the kidney area.We started cancer treatment this year but it was too late. Cancer doctor first gave an injection whose cost was 2 lakhs after that he said it is not working please go for radiation where we made 100% payment upfront.
Radiation planning for 15 sessions was done but no sessions were taken by father as his condition deteriorated.
Doctor again said to go for open surgery. We were reluctant but they assured all
Will be well so we went for it.Post which my father was not able to recover from the surgery at all and later after 2 months we collapsed.
After open surgery also when was fathers condition was not stable they gave another cancer injection costing 4 lakhs without proper consultation with us.
There were 3-4 instances of bacterial infection and fungal infection in the ICU when they gave expensive medicine after medicines in the name of treatment.
Now my father is no more and when I asked for refund of the radiation advance payment they are not paying it back.
Now please suggest do we have a case or not?
