April 18, 2025 at 4:24 pmstandard chartered card closed in 2000; seems like this bank sold their old accounts to some recovery agency/finlease in 2010; now out of the blue they have shared some Debt claim; to which contacted bank customer care who confirmed card is not in operation since 2000.this agency as typical practice keeps calling or going through call history n make random people calls etc.. on top of it their reply is We don’t give any damn to what Bank says; We are what we are.
to which I have replied I have nothing to do with your claim; go to Court n get a Recovery Order
funniest thing is there so called Legal notice has also Lokadalat like summons (as far as I am aware lokadalat notice is served only n only by Lokadalat and it takes place maybe once or twice a year; someone else too has posted a thread on LawyersClub of India in similar nature)
this case; Limitation Act these people cannot even goto Lokadalat forget Civil court
lawyer has asked me to file FIR with local police station for harassment and other fraudulent activities; and simply ignore them. there are 500+ complaints in consumer grievance of similar nature against this nbfc.
What should be done; so nonsense stops for once and all
Appreciate your Response

April 18, 2025 at 4:35 pmThat’s a pretty interesting case. Was there default on the card at the time of closure? Ask for NDC. It seems more like a scam to me as you said there are more than 500 cases against the agency already. For now either ignore them or complaint to Banking Ombudsman.-

OP
April 18, 2025 at 5:00 pmstandard chartered never contacted me over this card since 2000its 24 years; so obviously none of full n final statement like closure letter will be with me.
now if there was any default; bank would have contacted and followed as there is 3 years Limitation Act after which it becomes Time barred Debt
How can any agency wakeup after like 24 years and start sending out Debt claim?
when Bank itself never bothered or Ignored it?

April 18, 2025 at 5:14 pmDonβt overlook summons to Lok Adalat. Go there and challenge for proof of limitation. Also, send a legal notice against harassment to the recovery agency. It would shut them down real quick.-

April 18, 2025 at 5:36 pmthis type of cases do you really think Lok Adalat will accept them?similar thread ([Bank/recovery agency asking for credit card payment dues after 18 years – Civil Law](https://www.lawyersclubindia.com/forum/bank-recovery-agency-asking-for-credit-card-payment-dues-after-18-years-235553.asp)) both experienced Lawyers are even suggesting Lok Adalat notice recovery person is referring to seems like Fake
time barred debt; debtor cannot be taken to court unless they have accepted it or made any partial payments.
my case bank which they are referring to; has never ever got in touch with me for 24 odd years now; obviously never was aware of this card for last 2+ decades
I have discussed with both my lawyers n if they keep calling; will send Harassment and other section Notice as well make a FIR with all documents n bank emails

April 19, 2025 at 1:30 amNAL. Law is on your side. But Lok Adalat notices are sent in bulk. Consider 12 PSBs, 10-15 Private Sector Banks, Financial Institutions, and such authorised recovery agencies. Nobody has time to verify the notice.
If you go there and get a judgement that the claim is invalid, it would help you a lot in getting these people off your back.
And if they have any doubts remaining, a legal notice will take care of that.

April 18, 2025 at 5:39 pmThese days I keep getting those random dreams every few weeks where some one emptied my accounts/stole my purse etc.
Just yesterday I had a dream of a vacation, and for whatever reason I decided to join some launch party there where I had to use their wifi only to realise all money in my account is gone. -

April 19, 2025 at 7:04 amThere was a shitty Internet provider named Tikona from whom I had to avail wireless broadband service a few years ago. Their business went down the drain after I closed my account with them and say 5-6 years later I had a guy call me out of the blue and threaten me with a bill of about 7K to be paid since I didnβt pay the bill for the month post my closure. I was able to find the bills but since I remembered closing the account in full, I went full King Kong on him and said you do whatever you want but you canβt even pull a hair even from my testicle. That was the last I heard from him and later found out that it was some agency which had the customer details of all its subscribers and these guys were doing an organized crime using collection agents.Always, ALWAYS close anything with complete documentation and archive it in Google Drive or something and get a NOC/No dues document going forward

April 19, 2025 at 7:28 amagree2003 is like 22 years; you really dont keep old documents unless they are of very importance
scan documents or cloud-based solutions wasnt the thing then even whatever desktop/laptop you had; is not anymore around or usable
my case I have raised complaint with Standard Chartered Bank as well as all its Senior Managers
unless I get an Official Mail (on call they have confirmed 2003 and have promised data in 10 odd business days) cannot really send Notice to these people of Harassment
this Agency I have asked them to go to Court,
they use pressure tactics of 20-30 calls a Day
