OBackstory
This incident happened 30 days ago in the morning.At a crossroad, a woman riding an Activa scooter suddenly applied her brakes to avoid a person who was speeding. Due to her sudden braking, I, riding my bike, accidentally hit the rear end of her Activa.
The woman fell from her scooter, and my bike’s headlight got damaged. I, along with other bystanders, helped her to the side of the road as she complained of pain in her leg. I called her husband, who arrived at the scene and started shouting at me. To resolve the situation, I suggested they get an X-ray done to assess any injuries, and I assured them that I would pay for the hospital expenses.
Later that evening, they called me and informed me that the X-ray results were negative and that the doctor had advised her to rest. Without questioning or asking for any bills, I transferred ₹4,500 to them as compensation.
Now, 20 days later, the woman called me again and claimed she needed ₹1.5 lakh for a leg surgery. I told her that if this was true, she should file a complaint with the police.
They have now filed a complaint with the Traffic Police (L Division), and an officer has asked me to come in the morning to respond to the complaint.
My Concerns
My bike does not have insurance as it is very old (this was my mistake).The woman did not have a driving license at the time of the accident.
This will be my first time going to a police station, so I am unsure how to handle this situation.

RNAL I believe they are trying to take advantage of your vulnerability and the mistake of not having insurance.

OBut as per them xray on said accident day was negetive and there was no fracture nothing.
So how are they even thinking that after 20 days, someone will listen to them again.
In 20 days , Aunty could have slipped again and fracture same part.
Let’s go tomorrow and see what happens.

Ewhy did u even sent 4500 in the first place ? when it was not ur fault. They just trying to intimidate u. Get a lawyer and tell them u aint paying them a penny unless court orders u to do so.

OThat was my mistake and as its first accident ever ,i sort of panicked and sent them money.
It just how are they thinking of making this big matter when same day xray report was negetive

PYou should go to the police station and hear out what they say. If they ask for money, you can always say that the matter was settled amicably through a mutual settlement wherein Rs. 4500 you transferred and nothing happened thereafter. Now after 20 days they’re asking for more money, you have consulted your friend who is a lawyer and he states that this seems like a case of criminal intimidation. Say all this very innocently.
Because they had got the X ray done and everything was found to be okay. Now they’re blackmailing you and subjecting you to criminal intimidation.
If they ask for a copy of settlement, you can always say that the settlement happened on the telephone call after which you transferred the money to the women.
My suggestion to you is based on the statement made by you wherein you’re staying that she was found to be not injured

FKeep ur evidence of 4500 and get copy of negative x ray report on day of accident
Police means FIR of rash driving, rash driving culpable to attempt to homicide, 279, 338, 337. Also police will torture you by keeping 185.
The case is weak, however getting fake witnesses is easy who will say u drive in full speed and reek full of alcohol.
So they will then ask u for settlement of 2 or 3 lacs. Now u can negotiate 1.5 to 50k in court and settle with help of lawyer that no more future and legit clearing and opposition is ok and satisfied.
337,338 needs atleast fracture. Now that they can do it fake also post 20 days, can be one argument of ur lawyer. But our judiciary blindly support weaker vehicle and victim and in ur case woman means they love supporting them.
Again judiciary is corrupt and judge will drag cases and will need their share
Driving insuranceless vehicle is illegal
I paid 2.5 lacs via insurance macp case. Then for criminal cases, Lord Hanuman saved me with drink test document of victim who had 3x alcohol more than permissible limits that saved me. Else I spent 3000 kms travel from Chennai to Rajasthan where my accident took for some 10 court dates and it was one hell of a period of life.
India is best place for criminals coz they ain’t afraid to get bail, murder, extort but extreme tough for innocents who didn’t do anything but court cases are bad
Amicably settle it bro, 1.5 lac, they will surely settle in 1 lac.

FActually set police with 10k. He will ensure he sues the woman and u can relax.
Mine case, victim was himself politician so police couldn’t help when I offered 50k. I offer 100k to party. But they asked 300k in my case. So I had no options other court cases.i spent 5lacs in legal and travel and finally succeed magically. Else I was mentally prepared to appeal and settle at 3 to 4 lacs.
Victim was normal and walking and running but just has hairline fracture in my case and court called as grievous injury.

QBuy a third party insurance for your bike. It is relatively inexpensive, you can purchase it online. There isn’t any need for any inspection for purchase of third party insurance

SGo and see what’s the matter. If they ask for money for the surgery then probably tell them that you would pay medical bills directly at any government hospital. No private hospital, no private room and no medicine expenses included. And this time get everything in writing and make police a witness to the whole documentation. Also, do mention that the lady who was driving wasn’t carrying drivers license at the point of accident.

CDon’t go. Say you are busy.
After a few days of dilly daling ask for a copy of the complaint. This is an NC offence. No arrest.
Also ask for medical records. What is the problem? Why is the surgery required? What is the connection with you?
In the meantime get the insurance. The fine for driving without insurance is Rs 2000. Don’t bribe, if they ask for money, ask why? if the police say anything more, ask them to make a challan.

SIt’s clear case of extortion. Don’t spend on lawyer immediately. Tell to police what happened. Then according to their reply, go to lawyer. Remember police will also get a share of extorted money. They are calling to see you to check how gullible you are. Don’t be afraid. Tell them to log a case in court, which will cost a lot for them and then they will think about it.
Don’t show signs of weakness. Be confident. Save all chats from the woman.
