April 12, 2025 at 12:55 pmHi all, I need help understanding if I have any legal rights or chance of ownership under adverse possession laws in India.Here’s my situation:
• My father’s brother (uncle) owned a house.
• He had one daughter from his first marriage (his first wife passed away).
• He then married a second wife, and in 2009 he passed away.
• Since then (2009 to present – 15+ years), me, my dad, and my mother have been living in that house along with his second wife.
• The property title was later transferred to the daughter and the second wife.
• Now, the second wife passed away recently, and only the daughter is alive.We have:
• Lived in the house continuously since 2009.
• Never paid rent or had any written permission to live there.
• Handled some maintenance, possibly bills too (though they may not be in our names).
• No known will or tenancy agreement.I’m worried that the step daughter might now try to evict us. Do we have any claim under adverse possession since it’s been over 12 years of uninterrupted stay?
What kind of proofs should I start collecting?
Has anyone here seen similar cases?Any legal advice or guidance would be really appreciated. Thank you.

OP and family have been living in the property for free. Now they want to take over the house from the the rightful owner.

April 12, 2025 at 1:15 pmIt is not even his step daughter. It is his uncle’s own daughter from first wife. He thinks just because his uncle married a second wife, the daughter from first wife becomes uncle’s step daughter. Kali yug. Where do you get relatives like these ? 😬🤔🤷♂️🤷
