Can my company withhold my offer letter if i don’t serve the notice period instead pay for it (It’s mentioned in the offer letter)

My company has a 90-day notice period. In my offer letter, it states that “In case you leave your employment without giving requisite notice, no relieving letter will be issued.” and “In case you leave your employment without serving notice period, you are liable to pay three months (90 days) salary amount to company as penalty.” So if I were to pay for the notice period, would I get my relieving letter?
