Worker fell from under construction building and died

Using a throwaway for obvious reasons.

Yesterday evening a worker fell and died from the 8th or 9th floor of an under construction building in Mumbai.

He was taken to the hospital which is less than 100m away from the site but passed away.

This wasn’t picked up nor reported anywhere across social media.

In the evening all other workers were sitting outside the hospital and crying. This was a very moving situation.

There were cops who came to the site yesterday but later left.

Will the family of the dead worker get any justice or compensation? I was speaking to a friend in construction sector and he said the civil contractor will try to settle the case and not give any compensation to his family.

Isn’t this wrong? Why did a poor worker pay with his life for the lack of safety measurements at a construction site?

Is there any way to get justice for the deceased worker?

There’s this workman’s compensation act under labour law where the worker’s family is awarded compensation if the worker dies during the employment. This would be applicable if the construction company falls under this act. I would suggest you contact any local NGOs who would be willing to take up this case and consult a lawyer. I’m sure you can get some compensation legally although it may take some time.

Nothing can compensate death. But the contractor must have insured all the workers.

I feel so sad when I see these labour workers sitting at a height on fences with no safety gear and tools.

It’s like their life does not matter and even if they die, it’s not a huge deal. My heart really goes out to them.

There’s another side to the problem. Some refuse to wear safety gear citing discomfort.

This is true. When my building was getting painted, the workers had been provided safety gear but refused to wear it. They find it inconvenient to attach and detach the safety hooks on their harness.

of course his family will get the compensation from builder’s side/insurance, Govt side they might get something extra.

The contractor will pay off the cops and the family of the deceased. That’s the standard practice in the Industry.

The law is on paper. In theory he should get hefty compensation. In reality his family will be lucky to get a few thousands.

You can go to the police station and try to find out from them. How have they registered the accident and try to get a copy.

In reality you will need an NGO or a Lawyer who knows how to deal with such issues, under which law compensation is available? And of course you will need the family whose approval will be required for any paperwork.

You have to be quick. The contractor might have already settled with the family….

These guys tend to be drunk on duty and careless. Most of the time it’s their own fault for ignoring safety guidelines and practicing caution

If the worker is from UP/Bihar then nothing will happen. His family will get some pennies and that’s it.
