        Hi,

This is a very sad story for me. About 20 years back, when I was very young <10 years old. My father was arrested(for ~6 months, then out on bail till now) in some legal issue. We were a very happy fun loving family who had nothing to do with any wrong doings whatsoever but my family was broken apart because of this with every one being sad till now.

Its a very sensitive topic in my family, so we don’t talk about it. But I got to know some things about the case from my family and I wanted your advice on what should I do.

So the story goes something like my father invested some money in a co-op bank. That bank got bankrupt (AFAIK the bank was about ~5cr short of money) and he got to know that he was made a corporator without his knowing. A couple of people did some wrongdoings and 15 ish people who held posts in the bank were held. They were put in jail for 6 months(then given bail) and the case is still running till now(20 years later). AFAIK, my father can’t leave the town and has to go to court once in a few months to attend hearing. This case has made him depressed and it has broken him. It breaks my heart apart seeing him in this state for so long.

I built myself from scratch and earned some money. Now I want to resolve this issue. I don’t ask my father much on it because its such a sensitive issue. I once asked if we can resolve it, he said he didn’t do anything wrong and even if he pays his share of money, this wont get resolved because everyone needs to pay their share of money as everyone is held together. And few people will not pay up.

My questions to legal experts are:

        1. Other than what I know, is there something else that might be going on? What all can be inferred from the story? Why was someone put in jail without the crime being proven?
        2. Should I ask more things to my father?
        3. What should I be doing to resolve the issue? I don’t really buy that everyone will get out of the issue together. My father should be able to resolve it by paying his share of money? (It is also unfortunate to pay when you haven’t done anything wrong)
        4. Should I be separating out my finances/assets/liabilities?
        5. This has been running for 20 years (I don’t know why?). I guess both the sides don’t have any proofs. In sometime people involved would start to die? How does this end if nothing is done and hearing goes on?
        6. What are the options of getting it resolved? Only thing I can think of is 1 person pays all of the money? Anything else?

Without the details of the case it’s hard to say but

Getting bail sometimes can take a lot of time. Courts grant custody routinely and until you secure bail you rot in prison.

That is not a legal question

Your dad can’t just escape prosecution just because he can pay an amount. There’s not much you can do

You will not be liable in any way, but if you own property jointly with him, it may be an issue but even that is a remote possibility.

If it’s going on for 20 years in the trial court , honestly it’s not going anywhere.

          At this point that’s futile

Distressing though it may be, ignore the problem. In fact it’s now to your benefit to drag it on even longer since no decision means no conviction and no change in the status quo

What will happen after my father dies? Will the case go on or the courts will end the issue?

Are all his asset get subject to seizure? In that case, he should just spend it in his lifetime?

Asset seizure should have happened by now if it is to happen. When an accused dies during a trial or while an appeal is pending, the criminal proceedings against that deceased person are terminated as it is rendered infructuous.
