Who would file the case for black marketing

If person X buys concert tickets from person Y for people A,B and C and takes a certain commission from Y, what follows if the person Y fails to provide the tickets or the refund and person X approaches cops to recoup that money? And in such a case how are things handled while registering a complaint ? What about blackmarketing case and how to prevent that
