April 5, 2025 at 7:44 amAs per Supreme Court guidelines, the permanent maintenance after divorce cannot exceed husband’s 25% salary. My question is this true even in the case of a child?Also, if 25% is granted – alimony will still be paid over and above this maintenance order?

April 5, 2025 at 9:31 amThe facts in each case differ, as does the financial status of both parties. Permanent maintenance and alimony are mostly words used interchangeably, but in terms of what youβre trying to ask- the answer is no. If 25% is granted, that will be the permanent maintenance/alimony awarded to the party, however there might be an arrangement wherein the party agrees to give/accept a certain amount as lumpsum and the rest periodically, but for all practical purposes, both terms mean the same, between spouses. About the quantum of maintenance, the percentage might exceed 25%, depending on the expenses required to be borne for the child.
