        Hello,

        I have a sticky situation. We bought some land + house and rented it to the seller for the last 10 years. Now they’re refusing to leave the land on the grounds that the registration happened through GP from seller to me and sale deed from me to me.

        When we went to ask for filing an eviction suit, a couple of lawyers gave their opinion that what I did was wrong to get GP first and doing sale deed to myself. One lawyer told us to sell the property and he’s willing to purchase it. After getting all documents, he’s threatening that he can make sure we will lose the property and telling us to sell to him for less.

        What can we do against this please?

          Collect all the possible evidences. File An FIR in the police station and complaint in Bar council against the accused lawyer. Simultaneously, file a suit for eviction against the tenant. You don’t need lawyer for anything actually,basic research in the topic and common sense.

          Man, if property is registered on your name, none can take it from you. It will be long legal Battle.

              8-10 gunde hire kro, vakil saheb ki gend tudwao. Profit? Aur vaise bhi case ladna hi h to fauzdari ka lado, civil suit me kya rkha hai. Km se km meanwhile land to kabze me rhegi.

                    Lawyer here. First, viz. the lawyer, please collect all evidences and file a complaint with the Bar Council as also file an FIR.
                    Second, in so far as the Sale transaction, when you say the Sale deed is from yourself to yourself, do you mean you signed and acted on behalf of the owner as a GPA holder? Because even post the GPA, the title will vest with the owner and therefore he and only he could be the seller. Please elucidate on what exactly happened.

                      I am a lawyer and as others have suggested, collect all the possible evidence and write a complaint to the Bar Council of the concerned state. Also from what I understand, the original seller sold the land in question to you through a registered document where you acted on behalf of the seller pursuant to a GPA granted to you by the seller. I will be honest with you, the court won’t have a positive outlook against you as there is a direct conflict of interest. A question that immediately arises is this – why did the seller execute a GPA in your favour instead of selling the land himself in his own name. There are only two parties involved from what you say, so this doesn’t quite sit right with me that the seller would go about a transaction as routine as this in such a circuitous manner. There is definitely some foul play involved and if you are already not aware of the same, I suggest you take help of a good lawyer immediately.

                      But all this is on the merits of your case, as far as the behaviour of the lawyer is concerned, I suggest you take some stern action and immediately get another lawyer.
