May 8, 2025 at 8:03 pmOne of my known associate’s father expired recently. His father was angry with him since few years for some reasons and 3 years back his father executed a registered will towards a trust mentioning that the trust would be the legal owners of the property after his demise. however, recently the father had a change of heart and executed a unregistered will mentioning the son as the legal heir with signs of two witnesses. Sadly, the father expired a few days after executing the unregistered will.Now, after the demise of the father, the trust people are trying to takeover the house pointing the registered will in their name. The query is whether the son is the legal heir considering the unregistered will? If there are issues from the trust people, can the son contest it in court and would there be any chance of getting the house on son’s name?

May 9, 2025 at 3:39 amLawyer here. Unregistered will is still a valid will. This will be contested in court and the court will rule on which will to act upon. Its is most likely that the trust would say that unregistered will has been fraudulently made. Without perusing both the wills and proper facts, I cannot answer whether you have a good case or not.-
