March 19, 2025 at 4:39 pmI am writing to seek a little advice on this situation regarding a troubling situation that my mother,mwho serves as the head teacher at the basic shiksha gov school has been facing for the past two years.Recently, two temporary teachers at her school have been persistently filing Right to Information (RTI) requests against her, demanding access to sensitive school records and financial documents. Despite our compliance with all legal requirements and maintaining thorough records of all expenditures, these requests appear to be motivated by personal animosity rather than genuine concern for transparency since she refused to unlawfully add names of students who dont attend the school which they were not gappy about, she asked them to make sure that they attend school (which is there responsibility )or she will cancel there admission since thats the rule by the gov .
Key points of concern include:
Frequency of RTI Requests: The individuals have been filing RTIs under different names almost every month, which has become a significant burden on my motherβs time and mental health. Each request requires careful attention and documentation, diverting her focus from her primary responsibilities as an educator.
Court Proceedings: During court hearings related to these RTI requests, the individuals whose names are used do not appear, and only their lawyer is present. This raises concerns about the legitimacy of their claims and intentions.
The ongoing stress from these repeated requests and the pressure to maintain perfect records is taking a toll on my motherβs mental well-being. She is dedicated to her role and wants to ensure that her students receive the best education possible, but this situation is becoming increasingly overwhelming.
Given these circumstances, we are seeking advice on how to address this harassment effectively. Specifically, we would like to know:
Are there legal avenues available to challenge the frequency and nature of these RTI requests?
What steps can we take to protect my mother from this ongoing harassment while ensuring compliance with the RTI Act?
Is there a way to report this behavior to the appropriate authorities to prevent further misuse of the RTI process?

March 19, 2025 at 6:00 pmLawyer here, based in Delhi. This sounds like a clear case of RTI being misused as a tool for harassment. While transparency is important, the law was never meant to be a weapon for personal grudges. If the requests are excessive and disruptive, they can be denied under Section 7(9) of the RTI Act, since providing the information should not disproportionately divert resources. Your mother can also file a complaint with the State Information Commission under Section 18, pointing out the pattern of repeated, bad-faith requests.
