Is it better to file case against employer before or after leaving the firm?

My employer is deducting very big monthly contributions to pay my gratuity from the past 15 months and has also breached a contract.

I want the deducted amount back as wages and gratuity additionally as per the Indian Gratuity Act’s provision.

However, I am afraid I’ll be in a lot more trouble if I file a complaint after being currently employed. They can withold my salary and relieving documents, plus they may also withold the amount they’ve collected through my monthly deductions.

Any idea what should be done?
