I had been in search of a flat in desperation (as one does when new in the city) and liked a place where in the owner urged me to pay a token amount for locking in. This amount was to be adjusted against the security deposit when I move in.
I was verbally by the owner informed that there will be an increase in the rent next rental cycle onwards and all the standard clauses over a call and keeping those in mind I paid the token of 20k.
Post the payment the existing flatmates informed me that the rent cycle renewal is in 2 months and the owner is not going to be making a separate contract for me.
Upon speaking to the owner she told me I had to pay the increased rent and won’t be on a rental agreement until the next cycle. This was the conversation till 7pm evening. The following day I informed her that I’m not okay with the increment so we decided to call off the deal.
Now the situation is that she’s refusing to return the token amount. She’s said that only if she finds a tenant in 1-2 days she’ll return.
I obviously can’t be losing the money. Is there any legal action against this unethical behaviour?
TLDR: I paid a ₹20k token to secure a rental, but later found out the rent would increase in two months and I wouldn’t have a separate contract until then. I declined the deal the next day, but the owner won’t refund my money unless they find a new tenant in 1-2 days. What are my legal options?
