March 12, 2025 at 10:45 amI have been on notice for 85 days now, the notice period is 90 days long. I resigned on December 15th.The problem is, I have been absent from work for about 30 days during the notice period due to a combination of physical and mental health problems.
All my absences are marked as leaves without pay, and my separation policy states “leaves taken during notice period will be considered as LOP (loss of pay), however in situations where an employee has taken long leaves which has impacted knowlegde transfer to the successor, the notice period of the resigned employee will be extended by the number of days of leaves taken”
I do not have a successor and was not involved in any knowledge transfer.
The HR just told me that they’re going to extend my last working day, and I do not want it extended.
I am also considering absconding in case they extend the notice period.
The questions I seek advice on are:
1. Should I try to argue to the HR about the extension
2. Should I wait for them to communicate this in email and have a lawer review it?
3. Should I just surrender all company assets I have (only I cards at this pont, I’ve already surrendered everything else) on the 90th day and stop coming? They’ll probably initiate the absconding procedure, how should I handle thatOr is there any better way to go about this.
Your guidance is appreciated, thank you!
