May 2, 2025 at 3:33 pmI have recently baught a flat in a residential building in mumbai.
I baught a parking as well. It is a stacked parking of 1 + 1 structure. I have gotten the bottom slot. The one who has gotten the slot above me has a very heavy SUV (safari). He has parked his car on the stand. Stand is not able to lift his cae due to heavy weight of car. He is not cooperating and is not removing his car from stand. Thus i have to park my car on road.Residents association (society) hasnt been formed yet as it is a new building. The management of building is still with builder. Builder is supporting me but is yet to take any action after raising the issue 3 days before.
What should i do now ?

invoke trespass, criminal force.. if police refuses to file FIR, file letter with magistrate, he will order FIR
once FIR is lodged, your guy will come begging..do not try civil route via lawyer, he will play notice-notice & rob your money & there is no value to notice
This is the only legal way that is feasible

May 2, 2025 at 3:59 pmFirst of all Safari is a common SUV and if the stand is unable to lift it then you should question its quality to the Builders and why haven’t they thought about this before installing it.Secondly the allotment is brainless here, cant the builders and their managers take the extra step of considering asking the owners about their cars before allotting (given they should be knowing about the capacity of the stands they are installing)
Such carelessness from Builders is only gonna become a headache to both of you in the future.
The builder is clearly playing the smart card here by showing to be helping you while he is hiding his own mistakes. Since you also paid for the parking, there is no need that you should start your new residential life with legal issues with neighbours, instead, you deserve a peaceful beginning in your new home.
Turn it towards the builders and press it on them to either change the stand or change the allotments already.
