March 7, 2025 at 4:25 pmQuite a few reforms are needed, but the points that do come to mind immediately are:1. Personal appearance should be exempt for all parties/they should be permitted to appear through video conference in such cases – would save a lot of travelling and headaches;
2. The Family Courts Act, Hindu Marriage Act, Indian Divorce laws in general as it is, needs to be amended. The scope of court intervention in such cases like referring parties for mediation etc. needs to be curtailed and the grounds for separation and divorce need to be widened to include no-fault divorce – I am of the opinion that such provisions are an insult to the intelligence of adults in matrimony, if they want to separate, then let it be so;
3. Criminal procedure for such cases needs to be differentiated, and a standard operating procedure needs to be put in place – not everyone needs to be hauled to a police station in these cases;
Each point here could spawn research papers, but I think these should definitely help.
