May 8, 2025 at 11:26 amHello everyone,I’m seeking legal advice regarding a delayed refund from Lenovo India. Here’s a summary of the issue:
I purchased a laptop worth ₹64,000 from Flipkart on 02/05/2024.
The laptop started overheating and underperforming after around 9 months. I raised a service request on 27/02/2025. Lenovo attempted three repairs: first the heatsink, then the motherboard, then both together — all failed. Despite verbal assurances of 100% fix, the issues persisted. The last repair was on 26th March.
After much back and forth, Lenovo refused to replace the product and instead declared it a DOA case. The laptop was sealed on 4th April, and they issued a DOA certificate, promising a refund in 12–15 working days.
I handed the laptop to Bluedart on 24th April, but Lenovo rejected delivery twice, only accepting it on 30th April after I escalated via email.
Since then, they’ve only provided vague responses — first promising a 7 working day refund (which ended 2nd May), then changing it to “on or before 15th May.” There’s no concrete update or refund confirmation as of now.
Flipkart, on the other hand, has refused any responsibility, saying the pickup was initiated by the brand.
I have:
Multiple follow-up emails with no proper response
Filed a complaint on NCH (no response there either)
Audio recordings of refund commitments
Proof of DOA, pickup and delivery
My Questions:
1. Should I wait until 15th May or proceed with legal action now?
2. If I proceed legally, what compensation can I claim (I paid ₹64k; current price is ₹94k)?
3. Is filing via e-Jagriti worth it? How long does it take?
4. Can Flipkart also be held accountable as the marketplace?
5. Is hiring a lawyer necessary, or can I represent myself?
I’m mentally and emotionally drained dealing with this and would really appreciate guidance from anyone with legal knowledge or past experience.
TL;DR:
Lenovo declared my laptop DOA after 3 failed repairs. I handed it over on 24 April, but they only accepted delivery on 30 April. Refund was promised in 7 working days, then moved to 15 May. No proper communication since. Flipkart says not their issue. Should I wait or proceed legally? What compensation is possible? Is e-Jagriti effective? -
