March 1, 2025 at 4:39 pmI heard someone mentioning, I need to file any case within certain period like 1-2 months else it is called as Limitation (which means I crossed the duration limit) and I can’t file it further. Is it true? -

March 1, 2025 at 5:06 pmMaybe the bench can condone your delay if you prove your advocate did not file even though you did your part. Again it’s rare and I don’t see how you would prove that you paid for filing and another credible reason for why did you not follow up for 2.5 years when you could’ve checked or asked for any document, complaint etc -

Make sure you have all the proof.

March 2, 2025 at 3:49 pmYou could get the limitation condoned if you explain the situation you’ve mentioned here. Discretion of the court though. But you can try by engaging another lawyer. Also, I’d approach the Bar Council and file a complaint about the earlier advocate.
