        I have been under orthodontic treatment for ten months. Initially things were going just fine even though progress was very slow. I, nonetheless, kept making my payments on time and eventually ended up paying for the full treatment even before the treatment was over. Shortly after that, my orthodontist began ignoring me. She has no assistant and the clinic where she practises has no staff. I have to call her personally to make appointments with her. During the first few months, getting an appointment with her was very easy as her practice is very new and she has few patients (I only ever saw two patients in her clinic).

        But since the past few months, getting an appointment has become a hassle. She refuses to take my calls. She doesn’t respond to my texts. She keeps deferring the appointments even though I have been paying her a nominal fee for each appointment even after I already made the full payment.

        In the past week, things have come to a head. My extraction gaps are opening up and some of my teeth have begun to rotate. I have called her several times to get an appointment. But she refuses to set up the appointment. I don’t know what to do. It is not possible for me to switch to a different orthodontist as I have already spent a considerable amount for the treatment.

        Is there any legal action I can take against my orthodontist if not for physical harm, then for the considerable mental harrasment I have been subjected to since becoming her patient?

        Please help!

              Yes. She is a board certified orthodontist.

              You can take the doctor to consumer forum for compensation.

                      Find an advocate who specialises in consumer court matters! The first step would be to send a legal notice to the doctor.

                    File an P.I.L,one case she’s gonna be in trouble.and there is a chance, she’s gonna pay your amt back for settlement

                            Public Interest Litigation can be filed through consumer court…she has a business, you paid your amt..
                            still you didn’t get your service…. file and mental harassment complaint too…just get a lawyer,one summon from court and she’s gonna be ready for settlement,no one wants to ruin their business just for one consumer so she will pay you back more likely

                              And all you dumbasses think lawyers are useless and Google can help you

                                This is terrible advice. Do not file a PIL.

                                As others have said, you can consider filing a consumer complaint or a civil suit for recovery of money (if you are able to make out that you have faced any loss).

                                    Man it’s tough out there i suggest u find a better one or just go to her without an appointment as u have already paid full and she doesn’t give u anymore appointments . Be calm when u do so. Don’t make any fights cuz authorities will support the doctor over u. And always remember don’t make pre payments! Some people only work for money without doing their job! Also try to record incase of fights cuz she doesn’t have an assistant

                                      Don’t do anything. Go to her clinic with few relatives preferably parents and firmly ask the Assitant to call her and let your parents speak to her . I a firm tone ask her what is the issue and why appointments are not given on time. I’m sure things will be back to normal !!
