February 16, 2025 at 12:57 pmHere is a neatly framed version of your questions:I have a few queries regarding partition suits for land in Maharashtra:
1. Governing Law: Under which act are partition suits for land filed in Maharashtra?
2. Procedure: What are the steps involved in filing a partition suit?
3. Legal Proceedings: How do the proceedings unfold? Specifically:
β’ After filing the suit, how are notices sent to the respondents (co-owners)?
β’ What should the respondents expect on the first hearing?
β’ How does the case progress after the initial hearing?Hereβs a neatly framed version of context and query:
The land parcel in question is located in Uran, Raigad (part of the Third Mumbai region) and was inherited from the father. There are four co-owners: the mother, two sisters, and a brother.
Currently, the brother has complete possession of the land. The mother has filed a partition suit, making her children (including the brother in possession) the respondents.
In this scenario:
β’ How will the legal proceedings unfold?
β’ Will the brother, who is currently in possession, have the discretion to release portions of the land at his convenience?
β’ Can he decide which parts to release while keeping the portions he prefers?
