February 16, 2025 at 11:20 amIβm not looking to add just another drop in the sea given the current context. I just want to understand the legal protections for myself as a content creator and raise awareness for others surrounding me. -

February 16, 2025 at 11:25 amNALIndia has 3 definitions for weather you are resident of country or not, aadhar has it’s own, income tax has it’s own, fema has it’s own.
if you are not in jail, it’s just that state has decided to let you stay outside the jail or some wisdom or other distraction has allowed you to stay afloat. If state wants to trouble you, the law will have it’s own manifestation with it’s own interpretation out of thin air.
So the FoE is valid until you are not in limelight

February 16, 2025 at 11:35 amThe definition of Freedom of Expression in India is:Β Freedom for me, but not for thee. In other words, people with money and influence can say whatever they want whenever they want regardless of consequences, but people without money and power need to be censured by the State.Allahabadi is one person with money and influence in a face-off against the the State of Maharashtra, Assam, and Madhya Pradesh – states with more money and influence than Allahabadi.
So they’ll go after him until Ranveer’s mom and dad use their contacts in Central and State governments to let him off with a warning.

February 16, 2025 at 11:47 amArticle 19 grants Freedom of Expression, but thanks to the fuckery by Nehru before the first election, there are “reasonable” restrictions in the name of national security, integrity, public order, friendly relationship with other countries, and so on.In practice, this means a complaint can be filed on you for “hurting sentiments” if you say something some fucker find offensive. Now how the compliant plays out depends on the police (if they are competent or corrupt)…and if the police is bad, then your fate depends on the judiciary as at this stage you will have a FIR.
Does that mean everyone gets jailed? Nope. But the law is so bad that a politician in power can easily send you to jail.
