February 13, 2025 at 3:48 pmHi everyone, I need some legal guidance regarding a property dispute within my family.• My grandfather had 3 children (2M, 2F).
• In 1991, he divided his self-acquired and ancestral agricultural property into 3 parts: one for my father, one for my uncle, and the remaining for himself (to be later inherited by both sons).
• This division was done through an unregistered Panchayat Pal Parikath, and my aunts’ (2F) names were not mentioned.
• However, the land was registered under Form 20, which was incorrect as it is meant for Pouthi Katha.
• My father passed away in 2008, followed by my grandfather in 2009.
• After my grandfather’s passing, my aunts filed a partition suit in 2011, seeking equal shares.
• In 2020, the JMFC court ordered an equal 1/4th share for each child (including my two aunts).
• I have now filed an appeal in a senior court challenging this decision.My Questions:
1. Can I prove that the property was already divided in 1992 and save my original share?
2. One of my aunts (who is in financial need and whom I have supported) is willing to give me her 1/4th share via a release deed in exchange for financial help. Is it valid to execute a release deed while the case is in appeal?
3. If she legally transfers her share to me, can I claim two shares (mine + hers) without legal issues?Would appreciate any insights or legal suggestions. Thanks!
