February 13, 2025 at 3:14 pmHi there! Please help, I am need of legal advise regarding a car my father bought on loan back in 2011.He financed it through a local bank agent who was well known in the area.
He paid the loan on time and the emi ended back in 2018 and we weren’t given any reciept of payment but my father believed him as he was pretty respected but the agent never gave NOC and kept making excuses and refused to meet. He was never at his office and only his wife was there always saying he is out with a client. We wanted to sell the car but had no noc. Finally on being threaten that we will file a case, he admitted he never paid our loan amount to bank.
We tried connecting to bank about it but they weren’t any help. Few months back he went no contact and with bank and vacated both his residence and office.
The bank is asking 70k for further process. Do we need to pay??
What legal steps can we take against the bank to get our NOC??
Also is it possible to sue the bank for negligence on their part in telling us they haven’t recieved our payment and the harrasment we are facing contacting them everyday??

February 13, 2025 at 7:20 pmOk.The bank is asking for the amount because we contacted them to give us our noc because we have already paid after we got the number of bank manager last year. He is saying the account shows balance of 80k something and asking 70k for settlement and starting process of issuing noc. We got information of non payment at start of 2024 and been in contact with bank since but its a stalemate with my father saying we have nothing to pay and them asking for this amount as balance.
