Uone of my relative (M,27) was in a live in relationship with a girl. After 4-5 months they were deciding to get married after informing his family he found out that she lied about her age and never told her real age but he found an old identity card according to which she’s 34 years old. He told his family and they asked him to move out of the place and told the girl that we can’t go ahead with the marriage and now getting him married to someone else. Now the girl is threatening to file a complaint against the boy that he made false promises to marry and had sexual relations with her and then refused.
What are the options that he has now? Is this case valid? -

DNope here u can’t, suppose u met someone for the marriage and later u found out that there are some issues, or u have been lied or differences between both of you. Does not matter if sex is involved or not but if the girl decides to complain ( no evidence required her statement is everything) then the guy will be arrested and imprisoned for 10 years.
Now, if u reverse the gender and the girl decides not to marry then she is free to do so she can do whatever she wants. Nowadays even courts are observing the misuse of all these laws for personal vendetta and revenge but still they won’t do anything.
There was a principle , “Let a hundred guilty be acquitted, but one innocent person should not be convicted ”
Now it’s the opposite here “Let a hundred innocents be convicted, but one guilty person should not be acquitted”

UThe precident is you can’t have sex over fake promise of wedding. It is to prevent people from promising to marry while intending to fuck and breakup (Many women aren’t ready to have sex with anyone except future husband)

UI saw that in movies like raja ki aayegi baaraat but wasn’t sure it was actually true. These are horrible laws and need to be updated. If you aren’t happy having sex with someone you’re not married to, don’t, but if you do, don’t think they owe you marriage because they don’t. Everyone should have the right to change their mind, this is absolutely insane. Those of us born outside of India often romanticise being Indian and sometimes wish we were born/grew up in India as maybe it’d feel more homely (for lack of better word), it’s easy to feel torn as someone of Indian family background being born and raised in the west, but things like this really do make you realise how hard living in India must be. I am honestly shocked that there are legitimate laws stopping men from changing their mind about who they want to marry.

SOP, If your relative can prove she lied it will weaken her case.He should collect evidence and also file a police complaint stating that she is blackmailing him. This might put her on the back foot (hopefully).
Also, get a lawyer quickly so that he can file for anticipatory bail for when she files false cases. Avoid direct contact or any unofficial settlements. Handle all communication through a lawyer. Be ready to file cases to counter her false cases – defamation, blackmail, harassment if she continues making threats.

Trial will go on for 3-4 years. Unless quashing is done. With all the evidences 1-2 years it can be sorted out or with solid proof within 3-6 months depending on the evidences you have.Otherwise settlement has to be done.
She might extort money or will ask to marry her. Putting pressure on the family to dissolve the case. -

How long was the relationship?
How did they get a place to live in?
She never produced any documents or IDs or she forged all of those?
Does she work or study or just a homemaker live in situation? There are so many questions. The age gap mentioned is also not one or two but almost 8 years!! You can literally tell if a woman is 37 and not 26 just by looking!They were living in and the guy never checked anything? Like facebook posts of birthdays, year of graduation, classmates etc? Is that believable in today’s age and time? I mean will anyone believe this even normally let alone legally? You get a girl and flying in the clouds having a physical relationship for idk how long and then even moving in too… but don’t know any of her family or friends or anything? C’mon that’s just not possible. There must be some other thing going on. Or she is a con artist in which case he needs to do some mutual understanding out of court- because he ain’t winning this one legally.

She will file a FIR under New section BNS69(rape under pretext of marriage: false promise to marry)
This is non bailable. Session court might not give regular bail under this. You might end up in jail for 1-2 months. A month will be wasted under session court trial and then you have to apply in high court for regular bail.
Police might capture you without giving you a prior notice. Getting Anticipatory bail will be gone under this case.Record the threats and also records the line mentioning each and every detail that will show it was a breach of promise and it was the girl who lied about her age.
Second save all the recordings in your cloud and share it with your family.Get a lawyer ASAP file a FIR that this girl is giving you threats .
If you have a WhatsApp backup just use it to get the old chat records.
Deleting records are a bad idea. You should have some evidences to proof.Collect as many evidences you collect related to her background and personal info which tell that she lied about the age and was a major elder than you who trapped you in this.

LI am not a lawyer, but for your relative I can suggest these things:
1) Pray to God that she doesn’t file a case and finds someone else to marry or love.2) If she go aheads and file a case, there are plenty of judgement cases to support your cause but judiciary you know, it will take 4-5 years minimum to reach high court if you are middle class. Session courts will just see prima facie and convict you.
3) Gather any evidence that shows that she indulged in sexual relationship out of love and affection too and promise of marriage was not the only thing. For that her education, age would matter . Proofs like gifts, photos together in a restaurant can also come to rescue you.
4) Do not marry just immediately after the break up. Give it some time to cool down.
5) Get an aggressive lawyer and be prepared with atleast 10 lacs money for quashing, anticipatory bail plea, lawyer fees etc. Dont settle for a cheap one, you need someone who can move swiftly to stop you from getting arrested.
6) If FIR is registered against you and you know police will arrest you send someone you know to the PS and grease the OC.
7) Don’t compromise with the girl, rape is a non compoundable offence. Better pay money to police to lighten your chargesheet.
And think again if age is the only thing that bothers you about her, and she really did nice things for you, you should get married to her.

UAnyway, the guy is screwed royally for life for doing such things! He must pray almighty the girl doesn’t go all the way instead move on! She can always file case anytime if she wants, just imagine, the about to get married and she files a case! You can never trust lawyers unless you know them personally as someone suggested they always collude and try to make maximum. Even after settlement, the girl can always approach court for relief. Already court orders have acknowledged live-in relationship are as good as marriage. His marriage prospects also dim since they need to disclose this to the prospective bride! Who will accept this mess?

It might sound funny, but for example, if you’re facing business losses and start looking unkempt, you might see her exit without you having to deal with the situation directly.
You’ll need proof that she lied about her age.
The laws aren’t very favorable for men in such cases, I’m sorry. So in your situation, it’s best to hire a lawyer as soon as possible.

SConsult a lawyer but in reality in such cases men have no option but to have an out of court settlement. Pay her or convince her, there is no other way out of it. And never ever think of leaving the country in the hurry. If a case is registered the police would issue an LOC against the guy due to which whenever he steps into the country he would be sent straight to jail and his passport would be submitted in the court. So, no more leaving the country. Therefore, best option is to settle.
