February 9, 2025 at 1:30 pmMy father got into an accident in Nov 24 while driving through a tier 3 city in Maharashtra from Mumbai. A guy riding a two wheeler hit our car from the blind spot, front right corner. My parents closely escaped with minor injuries while that guy got a thigh fracture and his two wheeler was destroyed. Firstly there were talks going on about settling the matter, but when those guys demanded 10l rupees, we decided to take the legal route. Dad already paid his hospital charges for the night and ambulance charges to move him to a better hospital for surgery. We also offered to pay for his treatment at a government hospital where there would be minimal charges, but he willingly got treated in a costly private hospital, so we didn’t pay any more.An FIR was filed in December against my dad by that guy, and it has not yet been put in court (police haven’t given it much importance so they dillydallied the process a bit, dad has been there twice as per their request and it’s still pending, they told us theyd call him in a few days to file it in court, then do the remaining bail procedure). We read the FIR, there’s literally a blank in front of the other guy’s vehicle number, meaning his vehicle was probably not registered. He probably didn’t have insurance either, like most people from tier 3 cities. We have third party and self insurance and our car was repaired through our insurance in a service centre in the same city and we got it back in Jan 25.
Now we also received a notice from the motor tribunal at Belgaon in Jan, asking us to stay present in feb for a hearing. Apparently that guy has filed an insurance claim. In the petition his lawyer has mentioned that he is 100% disabled now and has lost 100% ability of earning, which is completely false. He is a hoax and I don’t think he’ll win in a fair trial, but I’m worried this case is gonna cost us a lot of our money, time and effort for the next 4-5 years. Should I be that worried? Please share your opinion or advice. Thank you!
