February 7, 2025 at 6:11 amMy friend is falsely accused in a FIR filed for vendetta.The police sent him a WhatsApp notice under BNSS 35. We know that according to recent supreme court judgement, electronic notice is not valid.
Now the police are calling him to ask for his address and aadhar card. They only have his phone number and city.
Should we give them this information?

February 7, 2025 at 6:19 amWe consulted 2 different lawyers.1 said you should co-operate with them so they can send you the notice. If you don’t co-operate, they find it more suspicious.
Another said, don’t share any information, don’t pick their calls.
The police called after sending WhatsApp notice and asked to come for inquiry.

I feel practical approach based experienced lawyers will ask you to avoid contacting them basically to buy time. The strict text book lawyers will tell you to reply to the notice or contact them. Both are correct. Depends on your case or what or how you intend to tackle the case.-

unless the FIR is serious, it can be ignored better yet leave it unseen. -
