February 2, 2025 at 8:16 pmI want to resign from my company properly and serve my full notice period. However, I am certain that my employer will withhold my last monthโs salary and service charge. (In my industry, employees are entitled to a share of the service charge collected from customers, which is distributed monthly.)The company has a history of not paying the last monthโs salary and service charge. Several employees who resigned properly and served their full notice period still havenโt received their final settlement. This has happened multiple times, and I am worried the same will happen to me.
My questions are:
1. What is the success rate of salary-related cases in India? Do employees actually get justice?
2. What legal actions can I take against my employer in this situation?
3. If I file a complaint, can my employer use their influence to manipulate the decision in their favor?
4. The amount may not be huge, but it is significant for me as I am facing financial difficulties. Can I really trust the labor court system to help me?If anyone has experience with similar cases or legal advice, please share your insights.
