April 28, 2025 at 6:28 pmIβm looking for some legal advice about my sister’s situation. Here’s a summary of what’s been happening:Marriage Duration: 5 years
Separation & Reunion: Separated for a year, then reunited after family intervention
Abuse: Husband has been physically and verbally abusive, using foul language and ignoring her
Recent Incident (New Year’s Day): Husband slapped her very hard after she questioned him about a cigarette packet; she has photos of the bruises
Aggressive Riding Incident:
While riding the bike as a pillion, he rode aggressively to scare her (she hates fast riding)
Skipped signals, rode at high speed, and almost caused an accident to frighten her
When she shouted to stop, he stopped and verbally abused her, using foul language and insulting her family
In-Laws’ Reaction:
When she complained to his parents, they dismissed her claims, blaming her for having a βShani problemβ and suggested doing a Pooja to fix the issue
Concern:
Now she is safe in our home but she is considering going to her place to get her things back and talk one more time about the matter. He is very moody and sometimes mentally unstable.
She is considering recording a conversation with him as evidence but is unsure about its legality and admissibility in Indian courts.
Questions:
Is recording a conversation (audio/video) legal and admissible in Indian courts as evidence or do they see it as breach of piracy?
What steps can she take to ensure her safety and gather proper evidence?
