April 28, 2025 at 9:07 amWe have a tenant who hasn’t been paying rent for 3 months. We served him a legal notice last week.
On the same day we recieved a civil suit for injunction from him, in which he states that we had an agreement with him that we will sell our property to him, and he paid us βΉ1,50,000 for it. He claims that we are trying to throw him out now and demands security from the court. He also claims that rent agreement is invalid. We recieved a court summon for the 2nd week of mayThis is all false as we never spoke about selling and got a rent agreement signed. We also took rent in online payments and never took this βΉ1,50,000 which he is just making up.
This tenant is a criminal and has a history of doing this fraud to occupy properties. He is framing us with this bullshit lies to try to own the property permanently.
We are speaking to lawyers, but does anyone have experience with this and advice on how we can get rid of this and save our home?

If you haven’t signed any such agreement and their is no money trail then there is no substance in his case he is just try to elongate the process, at this moment dont think about getting your 3 month rent. Simply try to file a FIR with police that he is not paying rent from past few mo ths and when you confronted him he threatened you with life and can even say he hit you, quote his past criminal history.
With help from police you can remove him from property citing threat to your life further proceed from there. -

April 28, 2025 at 1:44 pmBe ready to spend next 10 years in courts if you go by that route. Either pay him a little and ask him to clear out. Or bribe the police to make him leave the premises. Immediately occupy the property yourself and don’t leave it vacant. Go to the court on the next date for the case has filed and produce the evidence. But under no circumstance leave the property vacant. He would back off in a few weeks. -

April 28, 2025 at 3:03 pmHe wants to buy your house at a very low price by creating this drama. Give him some money and ask him to leave the house. Court case will be a hassle, Avoid it, and you wonβt get any rent while fighting a case. -

April 28, 2025 at 4:15 pmJust go to the police and ask them to help you evict them….just by saying the agreement is invalid it doesn’t become invalid …also file a counter FIR against the tenant for fraud asap ….and tell the lawyers what is going on and you can take all the proofs you have and submit it to the court ….if there is no physical evidence of such a transaction the burden of proof will lie on him because you have all your documents clear ….also if he used his wife’s aadhar card along with the other actions file a case for non payment of rent and overstaying even after notice against the wife -

1. Keep fighting case in court. It will take anywhere between 5-15 years but you will get your property back. Till that time, you will not be able to use your property.2. Find a local big daddy who can negotiate a deal. You will end up paying both the big daddy and the tenant but this is still technically the cheapest option
3. Hire some goons and throw the tenant out. In which case, be prepared for police cases and goons from other side too

April 29, 2025 at 6:04 amOption 2 is the best and cheapest. Similar thing happened to us. Tenant did not pay rent for a year. We negotiated directly gave them some money and reached a settlement.

April 30, 2025 at 12:10 pmLawyer here. You’ve already issued a notice.File a petition for eviction before the Rent Tribunal, depending on where you are.
As for the suit filed by the tenant, at this point you don’t have an option other than to contest the suit. Any advise on how to contest can only be given after going through the contents of his suit
