January 28, 2025 at 8:35 amI have been renting an apartment in Mumbai since December 2022. I initially signed up for one year, then renewed it twice for one year each (December 2023 and December 2024). So the latest agreement is over a month old. However, the landlord in question has not been paying the society maintenance charges for a year now. In addition, a couple of days ago, I also received a Property Tax Demand (Rs. 16K or so) from the BMC meaning he hasn’t been paying that either. I have been forwarding these to him over WhatsApp.
The society office is on my side, and are asking me not to pay the rent for the next month (I planned to pay it as per schedule on Feb 5). They say this will put adequate pressure on him to turn up and clear their bill. Should I proceed with not paying?
Also, I don’t want to deal with this headache anyway – can I just take the hit on my security deposit and walk away, no questions asked? The security deposit is worth approx 3 months of rent. The agreement has a clause saying there is a lock-in period of 6 months, but it also states in another part that the landlord is responsible for paying all the bills.
What should I do?
