House Owner is refusing to return the Security Deposit

He has been refusing to return the Security Deposit so far, and there are 4 days left for the notice period to end. All the bills have been settled and nothing to left to be paid for. He is telling he will return the Security Deposit only after a month, while the agreement states that he needs to return it when we vacate. How do we tackle this issue ?

Send him a Legal Notice. If he does not respond or return your money, file a suit for recovery.

NAL but you should not return the keys without getting the deposit. I find his intentions are not to give you back the security.

I think he will take security deposit from other tenant and give you from that. But verify and proceed with caution.

Don’t postpone the handing over the keys as many people suggested here

Postponing it nd keeping the key by yourself will give him the excuse that you are still occupying the flat.

If he is good guy mostly he is waiting for deposit from other tenants….do an agreement and move on

There is no rental agreement that says the tenant needs to wait for the owner to find another tenant before getting the security deposit back.

This simple fact that the owner is not honouring the agreement, automatically makes him NOT a good guy.

Tell him, I need to so that I can deposit to the other house you rented. That owner is asking.

And tell i can vacate the house if deposit not received by xx-xx-xxxx date.

If not did, then visit nearby police and submit your agreement copy and tell him to help in this matter.

Lock the house with your own lock. Also tell him in nice terms that his furnishings are costlier than security deposit.

Tell him that you will file FIR for cheating and it will come in his records and he might not be given loans and things like that

Ask him to issue you a cheque with a future date. Withdraw the cheque on said date. Stay firm on this.

I always pay 3 months rent as advance

Before vacating I always hold the rent in last 2 months and 2 weeks

Thus effectively paying 2 weeks advance for painting and repair charges

No hassles or headache

I’ve done this in 5 rental properties in Bengaluru, with no issues from the owners. Finding a good owner is the key.
