January 27, 2025 at 10:42 amSo to give some context, my Mom and her mother were part of a joint FD (either or survivor clause) for a considerable sum. My grandmother being thr 1st party and my mother being the second.
After my grandmother passed Mid 2024, and my mother tried to redeem the FD and it came to her attention that there was a suit filed by my mother’s brother claiming that my grandmother had willed the FD to him prior to her death with a registered will. After examining the will it seemed like it was forged after my grandmother’s passing and moreover it was not registered also.
For the past 6 months or so my uncle’s lawyers have been asking for a delay or have not been appearing for the hearings.
What’s the best way to handle this?
Someone recommended to approach the RBI ombudsman but we’d need some help in handling the same. Please advise. Thanks & Regards -

January 27, 2025 at 9:42 pmHi lawyer from delhi here!Anyway your mother is the owner of the 50% share and if the will is forged then file a lodge FIR for forgery and fraud.
Also, non registered wills don’t have legal sanctity in court.
So you have a win win case anyway. File your reply and also file a complaint with the banking ombudsman for release of the amount in favour of your mother and let him reply in writing.
