January 24, 2025 at 9:56 pmIll tell you a very very basic difference which stems all the other differences. The muslim law is still not codified in its entirety. The reason being that the word of Allah is supreme and as far as personal matters like marriage are concerned, either the Holy Quran or interpretations thereof govern all the matters you mentioned.
The SMA being codified makes the process easier and simpler because one does not have go into the interpretation of religious texts.
Again, every sect in the muslims follows different laws, and no its not just shias and sunnis. The laws differ with different schools- the Hanafi School is just one school, which is prominent in India.
Having said that, there are thosands of differences in each aspect- marriage, divorce, inheritance, legitimacy of children etc- between SMA and the Muslim law, and it is not possible to list them out here for itβs literally an entire subject in itself.
But if you have to choose one, go for SMA
P.S: my answer is just based on MY comparative analysis of the two laws based on hundreds of hours I spent studying them. I mean absolutely no disrespect.-
