USo, there’s this ancestral property in the outskirts of Mumbai. It’s about 100+ years old and a family is living there, they own it.
Apparently, there’s going to be public road widening work around the house and the municipal corporation have warned them to start the redevelopment of the house in a few years or keep fighting in the courts till they die!?Municipal corporation said that if not today then in the future they might have to give a part of their property to the government because of the town planning or surveys done. Isn’t that unfair? The surveys or planning were done years go, no updates on them with the current scenarios, while the house has stood there for more than a century.
So, right now they don’t want to go for the redevelopment for another few years or so, which is fair enough on their part because it’s their house.
Can they save it? Or will they just have to move along because this is India and laws doesn’t really work in the favour of a common man!Can such residential properties be protected?
Are there any laws?
Can they apply for it to be protected under the heritage?
What is the heritage act for such residential properties?
Does India have any laws to protect them? Is it worth fighting for?
Can the municipal corporation enforce such rules for the redevelopment even if the owners are against it?If you know any heritage conservation consultants or architects or businesses, do let me know.
Give some advice or any workaround for this.
