January 22, 2025 at 8:47 amNeed proper legal advice,My mother passed away about 4 years ago, I didn’t file varasa patra (legal hair certificate), I was told to file in a year, due to some issues I didn’t file it…
Now I got to know that I should have filed legal hair certificate immediately or within few months of her death.
People are advising me to file.case under hindu succession act in court because lot of time has passed.
Now what’s the procedure to claim the benifits?
Can anybody give proper solution?

January 22, 2025 at 11:44 amThe succession case will allow you to only take control of her movable properties. The question is what do you want to get?-

January 23, 2025 at 12:11 amLawyer from delhi here! You can still get a legal heir certificate and succession certificate then using these file a suit for declaration of title and demarcation of the property.
If there are multiple shareholders then file suit for partition.
Then subsequently a petition under hindu succession act can be filed.
