In 2005, her husband had an affair with her sister, and under societal and family pressure, she was forced to stay silent to support her three children, who were educated in government institutions without his financial help. Diagnosed with cancer last year, she and her children are now financially strained, while her retired husband spends his pension on his affair. Recently, he has been threatening legal action against her children unless she signs blank papers. She owns an ancestral property and a 30×40 plot given to her as part of past negotiations. The husband now claims to have legally registered a second marriage and threatens to exploit her children after her death.We are urgently seeking a lawyer or advocate in Bangalore who can provide legal advice and remedies to support her and her family.

January 20, 2025 at 4:16 pmRecord him when he talks about the second marriage and threatens her and the children. Second marriages are illegal if they’re not muslims. Ask her to collect evidence of his affair and advise her to not sign any papers. Record him pressuring her to sign the papers too. They have been together for a long time and they even have kids. he will have to pay maintenance and alimony. If the children are minors, he will have to pay for the child support too.Go to the police station, police are helpful unless that man has some contacts there. They will help you with government lawyers. They’re free of cost as far as I know.

January 20, 2025 at 4:28 pmThey are Hindus. He has contacts, local thugs. And even the other lady, she studied law, never practiced, did not go to a job. But she has friends who are session judges/lawyers. The husband himself when to the police in November when she did not sign, he gave false complaint stating that she and her children are beating him for pension money. They went to station but after hearing to their side, the police probably felt it was a complaint with malice intent. They warned him verbally, and asked everyone to go back home. She presented a copy of her complaint but they naively told her not to give it as he is old and she is ill.ยSince December he has not asked her to sign any papers, but he occasionally warns her that she can’t do anything. She will die eventually, the property that’s left with her will be transferred to himself through hook or crook.ย
Three chidren are grown up, struggling to get their life together. They are taking care of her cancer treatment, which is a lot. They don’t want to do anything with their father.ย
All the mother wants is to bring him to justice of his second marriage. That’s the only way she has. But she doesn’t have any proof that it is registered. But the husband revealed it to a few people in November. How can she collect this certificate?

January 20, 2025 at 5:38 pmPractising advocate here:Ask your neighbour to file a 498A complaint againt her husband. Furthermore, if the second marriage is registered, file a case of bigamy against him as well.
I don’t think his threat of legal action against her children carries any water. People love making tall threats that cannot be followed up.
As far as the property is concerned, make a will ASAP.
I am very sorry that your neighbour is going through this, but there are remidies available.

January 21, 2025 at 4:11 amHello, thanks for your message.ยAre you based in Bangalore? Or do you know a lawyer who can take up their cause? I think even filing an FIR will need a presence of a lawyer as the husband has adverse influence with local thugs who tend to deter it.
I would greatly appreciate if any lawyer can atleast meet up with them and discuss.
