January 17, 2025 at 3:25 pmHi, Iβm starting to date and have realized thereβs a high likelihood I might be in a live-in relationship once things get serious, especially due to the practicalities of renting a house and ensuring legal protection for both partners.I want to know:
1. Legal Validity:
Is it possible to create a legal contract for a live-in relationship in India? Does it hold up in court?
2. Key Clauses:
What should be included in such an agreement? For example:
Financial responsibilities
Shared expenses (e.g., rent, utilities)
Property ownership (if applicable)
Terms for separation or dispute resolution
3. Breakup Scenarios:
How can we legally address what happens if we break up in the future?
Are there provisions we can include for dividing shared assets, handling debts, or moving out?
4. Registration and Process:
Does the agreement need to be notarized or registered?
Should we involve a lawyer in drafting it?
5. Rights and Limitations:
Does such an agreement provide any legal rights similar to marriage?
Are there any specific laws or protections for live-in relationships in India?
Are there any limitations on what can be included in the agreement?

January 17, 2025 at 6:58 pmYou can have a general contract solely on the basis of Sharing expenses and utilities and the contingency clauses regarding someone living out and how everything will pan out financially and ownership of movable props. However, as and when you get opposite sex involved in this equation itβs a whole new ball game. Sadly there is no law in this country which will acknowledge such contract esp with live in partner with whom you are romantically involved.
And if shit hits the fan( which you are anticipating) she can charge you under BNS or even claim maintenance. So choose wisely and smartly with whom you intend to share the space with because no law in India will cover your ass except you yourself.
