January 17, 2025 at 12:14 pmMy uncle and aunt and all of my family is going through the worst. We received the news today on 17 Jan, 2025. Reports said that the child passed away almost a month ago in late December due to the end of oxygen supply. The doctor whom they were consulting said everything was fine and they should come after Bihu festival for operation. The doctor probably in greed of money or for his holidays or something just delayed the procedure so late that my cousin is not anymore in this world. My other big uncle will take a report of that doctor after the procedure is completed and my uncle and aunt go home safely.
What to do in this situation? What more evidence do we need to frame that doctor a life sentence. All this for his negligence. -

January 17, 2025 at 12:19 pm1. You need evidence for medical negligence. Gather that evidence.2. Get opinions from different doctors to understand the case better.
3. Do not beat up the doctors. File a criminal complaint and a case in consumer court, but do not beat up the doctors.

January 17, 2025 at 12:38 pmI’m assuming your cousin was the unborn child. There’s nothing you or anyone can do about a child dying in the womb. The only thing that can be done is to do a c section earlier but that would result in a pre term child, still won’t ensure survivability. I understand this is a very tough situation for you and you wanna blame people for it but the fact is that this is no one’s fault.-

January 17, 2025 at 1:04 pmNAL( A doctor here)If USG scan showed beating Heart & no congenital abnormalities in the foetus & if there were fetal movements & Fetal Heart rate during examination, the doctor is very right in saying the child was healthy & alive.
No one can pinpoint the cause for low oxygen that lead to fetal death. Many causes for fetal death ultimately lead to low oxygen.( Low oxygen is a very non technical/vague term)
Not aware about how the other doctor could say the child would have died almost a month ago. I am unaware of how he told the exact duration.
You can take the case legally if you want to.
Out of context: The very fact that you wanted to beat up a doctor without having the facts & only because you are emotional, sums up why most doctors want to leave this country or get done ‘n’ no of tests for double/triple confirmation (where patient parties blame the doctor for doing ‘unnecessary’ tests) & most doctors act disconnected with the patient parties.

January 17, 2025 at 1:05 pmEVEN IF the last ultrasound showed a viable baby [normal growth for gestational age & normal heartbeat] there is ALWAYS a chance that baby dies inside the womb somewhere between the last & present ultrasound โ for no obvious reason. Pregnancy is not devoid of risk even if everything appears normal. To allege negligence, first there has to be negligence. An unexpected unfavorable outcome doesn’t automatically mean negligence. An no doctor will compromise on the wellbeing of the mother & baby merely for their convenience. -

Are you sure there was no injury to the mother? any toxicity? If the regular reports suggest no abnormality in the vital signs of the fetus, it’s hard to frame the doctor for this.
– DOCTOR DID NOT DELAY THE PROCEDURE, Normal gestation period is 9 months, you cannot operate before the delivery date and it could be after bihu festival
i’m not a legal expert but a healthcare professional. My take is , it’s a normal stillborn/unfortunate death.

January 17, 2025 at 1:08 pmThere are lot of factors that might have caused this, you simply cannot blame the doctor , doctor is not there to play god, they will guide you and treat you whenever possible, there are limitations to human kind, if there is medical negligence you need the proof. Healthcare is expensive, you’re paying for the cleanliness and qualifications of the lower staff like nurses to technicians , first process the loss , few things might not have an explanation you cannot do anything about it. You are just using doctor as a scapegoat to throw your emotions and play the blame game . You can take a second opinion or ask for an explanation as what could be the possibility or health conditions associated with this , so many variables in play like if the marriage was within the family, age factors , genetic susceptibility, anatomical structure variations or deformatities, and so many more. You will gain nothing by behaving and thinking like this , this is peak indian mentality, if a lawyer loses the case does anyone go sue the lawyer for loosing it , or when a building collapses and kills people do people go after the civil engineer, NO , right? -

What is even the evidence that there was an abnormality detected that led to this?Your cousin died and you automatically decided it was due to the doctor’s fault without any evidence to the contrary. Before you even decided to post this, did you at least check with another doctor as to the cause of this showing scans or results obtained before?
No, you didn’t do any of these and instead directly went to blame the doctor while also indirectly suggesting that his bones should be broken.
Doctors aren’t gods that can save anyone or everyone. Unless there was some evidence that a doctor deliberately did this, you have no case at all.

You should have gone for a second opinion, and now that you aren’t satisfied with the doctor, file a negligence lawsuit. Stupid moronic behaviour. But no I did the doctor a favour by not beating him up. -

If the previous scans, lab reports and clinical examination did not show any abnormalities the doctor had no reason to suspect anything wrong.
Your gynac canโt change lab reports and scans himself just because he wants to go on a holiday.Secondly, get the correct diagnosis. โEnd of oxygen supplyโ means variety of things from congenital malformations, uteroplacental insufficiency, umbilical cord injury/ infection/ malformation and 50 other things, many of which can be picked up on scans and reports, while a few conditions present in a very short time and lead to fetus death.
So understand what it was before bouncing on the doctor.Thirdly, I understand your loss but get out of the โsaare doctor chor haiโ mentality. Even the most average doctor goes through a lot of training and is a human at the end of the day, talk to him like one.
Your entire post reeks of how to destroy the doctorโs life without once educating yourself.
People like you are hell bent on beating up doctors without realising how much training, duty hours, exams and stress that doctor has gone through to sit where he is today.
