January 16, 2025 at 7:01 pmI have been employed with an entity for 4 years. My offer letter had notice period mentioned as 30 days. Now, my role was changed through an internal job posting. For the new role, I was only given a one pager offer letter with only my new designation and new salary mentioned. I eventually found a new opportunity in another company in less than 3 months from this change and decided to move out. Suddenly, I see my notice period in the system is shown as 90 days.I was not given any intimation in writing about this change in my new offer letter, nor is there any policy about 90 day period nor did I agree to it. When raised to the HR, they are saying its a lead position and therefore you will have to serve 90 days, however I am very low in the organization hierarchy.
Legally speaking, can the company force me to serve 90 days or do I have a strong case to get out in 30 days?
