May 6, 2026 at 8:03 amHi everyone, I’m looking for some legal guidance regarding a complex and escalating family situation involving my father, his brother (my uncle), and my grandmother. We are currently based in India and things are getting quite stressful.
**The Context:**
My father has been receiving his pension for the last 2.5 years. All his service documents and verification processes were cleared by the state government at the time of his retirement. However, we are currently embroiled in a heated land dispute with my father’s brother.
**The Current Issues:**
1. **RTI Harassment & Threats:** Because of the land dispute, my uncle has filed an RTI (Right to Information) query to investigate how my father secured his job decades ago. He uses this as a daily tool for intimidation, threatening my father’s reputation and peace of mind despite the government having already verified all documents.
2. **Grandmother’s Pension:** My grandmother has been receiving a pension for 35 years. For a long time, my uncle allegedly blackmailed her and took her money directly from the bank. He does not look after her at all. Currently, my father is the one bearing all of her living and medical expenses.
3. **The Gold Dispute:** My grandmother had 150g of gold. My uncle took possession of all of it and is now refusing to return it despite multiple requests.
**My Questions:**
• **RTI:** Can an RTI filed out of personal malice/land disputes be contested? Since the state government has already verified his documents for the pension, does my uncle have any actual ground to cause legal trouble regarding a job from 30+ years ago?
• **Elder Abuse/Financial Fraud:** What legal recourse do we have regarding the “looting” of my grandmother’s pension and the 150g of gold? Can we file a complaint under the Maintenance and Welfare of Parents and Senior Citizens Act?
• **Harassment:** What is the best way to document the daily threats so we can seek a restraining order or file an FIR for harassment?
If there are any lawyers here or anyone who has dealt with similar “family RTI” harassment and land disputes, please let me know what our next steps should be. We want to ensure my grandmother is protected and these threats stop.
**TL;DR:** Uncle is using RTI to harass my father over a land dispute, stole grandmother’s 35-year pension and 150g gold, and provides no care for her while my father pays for everything. Need legal next steps.Took help from Google Gemini to frame my sentence.Please help

For gold and pension being taken by fraud file an fir it the police don’t take action file an application in court under 156(3) to direct police to file an fir and investigate-

May 6, 2026 at 1:41 pmPension / service records are personal information and cannot be shown to third party.After 4 years , as per Supreme Court orders no pension can be stopped in most cases.
Generally , offices keep recieving such rti and know to ignore it.
I recommend that your father go to the office and politely ask them to keep photocopy of all documents to be on safe side.
Nal, but dealt with rti and pension for a good part of my career.
