I read all rules and regulations proposed by DoPT, Govt. of India before applying.RI first said, we will first check how much share your father will get from the undivided ancestral property? (As per DoPT FAQ’s Question no.- 4, Grandparents undivided property will not be considered as family assets). After so much effort she get convinced.
Now since we are living in a RENTED house she saying we have to measure your rented house if it exceeds the limit we will reject your application.
Her main point is this:- “Person whose family owns or **POSSESSES**, residential flat of 1000 sq ft. and above shall be excluded from being identified as EWS.” This is one of the written rule for EWS.
Her argument is you are **not owning** but **Possessing**, so you will be excluded from the EWS list. She is playing the word game.
ChatGPT said Rented house is not consider under family income & asset so, it should not be included.
Also ChatGPT said if they reject your application for this house and suppose in future your house owner apply for EWS still they will again reject their application for stating the same house and they can’t reject two application for the same property. This idea also make sense.
My question is “What is the actual definition of the word POSSESSES in legal term?”.
Any example of difference between OWNING and POSSESSING?
I’m satisfying all other conditions of EWS rule except this Rented house problem.
