May 5, 2026 at 9:18 amIโm dealing with a notice period / salary in lieu situation and could use some advice.I resigned from my company and clearly stated that I was willing to serve my full notice period (3 months as per my understanding of the contract). However, HR told me there was nothing to hand over and relieved me immediately. They also disabled my work access the same day.
After that, I received communication saying my salary would only be processed till my last working day. I did not agree to being relieved early and had explicitly said I was willing to serve the notice period.
I followed up multiple times over email, referencing that because I wasnโt not allowed to serve the notice period, then salary in lieu of notice should apply. HR initially said they would get back to me by the weekend, but now itโs been several days with no response despite follow-ups.
It is clearly written in the contract that this contract can be terminated with a 3 months notice period if employee is confirmed or payment of the sum equivalent in lieu of notice.
At this point:
I have everything documented over emailI did not agree to immediate exit
They have not confirmed anything about notice period pay
My questions:
In India, can a company relieve you immediately after resignation and not pay notice period salary?Whatโs the best next step hereโkeep following up, escalate internally, or send a legal notice?
Has anyone dealt with a similar situation and actually recovered notice period pay?
Would really appreciate practical advice on how to handle this.
