May 5, 2026 at 5:53 amMy grandfather purchased two adjacent plots from the same seller around 1980. One plot has a registered sale deed (our house is built on it). The second adjacent plot was purchased through an Ikraarnama (agreement to sell). Before the seller could execute the sale deed, he passed away.We have been in continuous possession of this second plot for 40+ years, using it as a garage, garden, and storage.
Evidence we have:
– Original Ikraarnama (1980)
– Old photos showing possession/use since at least 2001
– Neighbours willing to testify about long possession
There is a separate neighboring plot (not ours). That owner entered into an agreement with a person (X). In Dec 2021, X demolished the structure on that neighboring plot, after which both lands became one open area and boundaries became unclear.
Since then, X has been claiming our plot.
In 2020, X produced a backdated rental agreement allegedly signed by the original seller of our plot, claiming my grandfather was only a tenant. This appears forged, especially since the seller had already passed away.
Case is already ongoing in court regarding this dispute.
On 3rd May 2026, X used a bulldozer to demolish our garage and also broke our secondary gate. We have CCTV footage of this demolition. Our house is now exposed from the side, creating a security risk.
X has local political backing. Police have not taken effective action. We have filed a complaint on the CM portal.
Current risks:
– Continuous threats. Xโs men are frequently present around our house
– Open access to our property after demolition
– Risk of further encroachment
Limitations:
– No separate electricity/water bill for this plot (shared from main house)
Questions:
1. Can we urgently rebuild a boundary wall/gate for safety while the case is pending?
2. How to get immediate court protection (status quo / injunction / police protection)?
3. How to prove the rent agreement is forged. Can court order forensic verification?
4. What action can be taken for illegal demolition and threats despite police inaction?
5. Is claiming adverse possession viable in this situation given 40+ years possession but ongoing dispute?
