May 5, 2026 at 4:34 amIβm looking for some advice regarding a long-running builder dispute involving my family.My father had purchased a flat in Greater Noida and made the full payment to the builder. The possession was supposed to be given in 2016, but the project was never completed, and he has still not received the flat even after all these years.
When he asked for a refund, the builder refused. As a result, my father filed a case in the consumer court.
During the proceedings, the judge observed that:
– Full payment had already been made
– Despite that, possession had not been given for many yearsAt one point, the builder even agreed (in writing) to return some amount as a settlement. However, we decided not to go for an out-of-court settlement and chose to wait for the final court decision.
Now the situation is:
– The arguments are complete
– The order has been βreservedβ by the court
– It has been around 6 months, but there has been no update or final judgment yetWe also feel that, given the long delay, we should receive not just the principal amount but also interest on the money.
We are unsure about the next step.
Should we:
– Continue waiting for the final order?
– Ask our lawyer to push for pronouncement?
– Reconsider settlement with the builder at this stage?Any insights from people who have faced similar situations would be really helpful.
