May 4, 2026 at 5:20 pmI’m looking for legal advice regarding what appears to be a fraudulent purchase on Flipkart. On 28 April 2026, I ordered an ASUS ROG Ally Z1 Extreme (RC71L-NH001W) listed as brand new for ₹51,990. The seller was DealsPeDealsIndia, and the product was delivered through open-box delivery. I recorded the entire unboxing process as I was already a bit cautious.After the delivery, when I checked the device through BIOS and verified the warranty, it became clear that the unit I received is not new. The serial number on the box (90NV0GY1M000C0) does not match the serial number shown in the BIOS (R6NVKD00772326B). On top of that, the official ASUS warranty check shows that the warranty expired in July 2024, which makes it almost two years old. The Xbox Game Pass that was listed as part of the purchase was also missing. All of this strongly suggests that I was sold a used or refurbished device while being charged for a new one.
Since then, I’ve raised multiple return and refund requests with Flipkart, along with several chats and calls to their customer support, but there has been no proper resolution so far. They seem to be delaying the process and have not approved a return or refund yet. I’ve also contacted ASUS for written confirmation regarding the serial number mismatch and warranty status, and I’ve already filed a complaint with the National Consumer Forum. I’m prepared to take this further legally if needed.
One additional concern is that when I raised this issue publicly on Twitter/X, Flipkart’s support asked me to move the conversation to DMs instead of addressing it transparently, and I was even asked to delete the post, which felt quite concerning. Given this situation, I’d really appreciate guidance on a few things. Does this qualify as cheating or fraud under IPC, or is it treated purely as a consumer dispute? Should I consider filing an FIR at this stage, or continue through the consumer forum route? Also, can Flipkart be held liable along with the seller since the purchase was made on their platform? Lastly, are there any additional legal steps I should take to strengthen my case?
I have everything documented, including the unboxing video, invoice, BIOS screenshots, and warranty proof. I’m not planning to drop this and want to make sure I take the right legal steps from here.
