May 3, 2026 at 11:30 amHi everyone,I’m dealing with a property dispute within my extended family in Uttar Pradesh and would really appreciate some practical advice.
My grandfather and his brother originally had equal shares in a piece of land. My grandfather’s brother has passed away, and he had two sons. My grandfather also has two sons (including my father).
One of my grandfather’s brother’s sons built a house on their portion of the land. During construction, he extended a porch/window structure about 1.5 feet into our side. At that time, my grandfather objected, but they agreed verbally that they would remove it whenever we decided to construct home on our side.
Now we’ve started constructing a boundary wall on our portion, and they are refusing to remove that 1.5 ft extension. Instead, they’re claiming they have a right over that area.
Things have escalated — they’re even threatening workers, saying they’ll break their hands if they continue the construction. Because of this, the workers have stopped working.
I’m trying to avoid going through a long legal process in court. I’m looking for a quicker, practical resolution. I’m aware that in UP sometimes local authorities like the lekhpal or police can intervene (even unofficially), and I’m open to that route if it helps resolve things faster.
Both sides believe they are right, but it feels like they are just making excuses now because their house is already built.
What would be the best way to handle this situation quickly and effectively without dragging it into court?
Any advice would be appreciated.
Edit: Police came and measured that we have even given them 1.5 ft of extra land so that they dont trouble us. The police said you continue your work no one can stop until there is an stay order from court. Later the same day other party went to the same police station and may be he bribed them. Some other police officers came and asked us to stop the work, took all phone numbers. They asked both parties to come to police station and resolve this matter. We know we are right here but we are failing to prove that. They have encroached our land with illegal construction but we can do anything about it. Feeling helpless now. The judiciary system seems flawed.
