May 3, 2026 at 5:37 amHi, I need some clarity on whether this is legally acceptable in India.
Situation
I was on a 30 Mbps broadband plan
My billing cycle resets on the 6th of every month
On 2nd May, I upgraded to a 100 Mbps plan
What happened
Speed upgrade worked (100 Mbps after 12 hours)
But I was given only 100 GB of high-speed data until 6th May
What the plan claims
The upgraded plan is marketed as “unlimited”
On checking later, it seems to have a 1000 GB/month FUP limit
The issue
I was not informed anywhere during the upgrade that:
Data would be prorated
I would only get ~100 GB for the remaining days
There was no clear warning or breakdown before payment
The UI simply showed the plan as “unlimited”
But this was not disclosed upfront
My questions
Is it legally valid for an ISP to:
Advertise a plan as “unlimited”
Then provide only ~10% of the monthly high-speed data due to mid-cycle upgrade
Without clearly disclosing this at the time of purchase?
Does this fall under:
Misleading advertisement, or
Unfair trade practice under consumer protection laws?
Do I have grounds to:
File a complaint with TRAI / consumer forum, or
Ask for compensation / full data allocation?
Additional context
I haven’t purchased any add-ons yet
I still have to wait until billing reset to get full quota
I can gather screenshots of the plan page if neededLocation: Uttarakhand
