* We are a family of four:
* Father
* Mother
* Elder brother (33M)
* Me (30M)
* My brother is an NRI, currently Indian, but likely to take US citizenship in the coming years.
* He is married to an American citizen and permanently settled in the US.
* He wants to financially support our family by funding the apartment purchase as a gift to my parents.
* He does NOT want his name on the property because:
* He does not want legal/property management obligations in India.
* He wants to avoid future travel or paperwork burdens.
* He wants ownership to remain simple for family use.
* I also do NOT want my own name directly on the property right now because:
* I am currently unmarried.
* As a precaution, if I marry in the future and the marriage fails, we want to reduce risks of potential matrimonial or property disputes involving a spouse.
* I will personally pay for the apartment interiors and furnishing.Current proposed structure:
* My brother gifts funds to my parents.
* My parents purchase the flat from the builder.
* Property is likely registered jointly in my mother’s and father’s names.Professional advice so far:
* Our CA suggested parents own the flat and create a will naming me as beneficiary.
* My brother suggested possibly creating a trust.
* CA warned that trust structures may complicate future transfer or sale.Questions:
1. Is parents owning + registered will the best structure here?
2. Would a trust offer better protection, or would it create unnecessary legal/tax complications?
3. Can trust-owned property be sold/transferred easily later?
4. What is the proper process for drafting and registering a strong will in India?
5. Are there tax, gift, FEMA, or inheritance issues with an NRI brother gifting large funds to parents?
6. Since I’m contributing to interiors but not ownership, are there legal concerns I should consider?
